Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of Croatia. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Croatia.

Service Description
Eksaria provides professional 3D printing services for prototypes, custom parts, and production runs. We accept STL, 3MF or OBJ files and provide instant price estimates based on your selected print settings.
AI Assistant: Our website features an AI-powered chatbot to assist with general inquiries. While we strive for accuracy, AI-generated information is for informational purposes only and should be verified by our team for specific technical or pricing requirements.
User Responsibilities
- You must own or have permission to use any 3D models you upload
- Files must be in STL, 3MF or OBJ format and under 100MB
- You are responsible for the accuracy of your shipping information
- If using locker delivery (BoxNow), you are responsible for collecting the package within the specified timeframe
- You must provide accurate payment information
- You must comply with all applicable laws and regulations
Data Processing and Privacy
By using our services, you acknowledge and agree that we will process your personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).

Consumer Rights and Withdrawal
As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or e-mail to contact@eksaria.com).
Effects of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
Important: The right of withdrawal does not apply to goods made to your specifications or clearly personalized, or goods which are liable to deteriorate or expire rapidly. Custom 3D printed items are considered personalized goods and may not be eligible for withdrawal once production has begun.

Payment Terms
Payment is required at the time of order placement. We accept major credit cards through Stripe and PayPal. Prices are displayed in EUR, USD, or GBP based on your selected currency preference.
Pricing: All prices are calculated based on material costs, print time, and complexity. Final pricing will be confirmed before payment processing. Prices do not include applicable taxes, duties, or fees that may be imposed by your local jurisdiction.
Currency: You can select your preferred currency (EUR, USD, or GBP) during checkout. Exchange rates are updated regularly to reflect current market rates.
Custom Services: For custom projects, bulk orders, or specialized requirements, you can contact us directly at contact@eksaria.com to discuss your needs and receive a personalized quote. Custom orders may have different payment terms and timelines as agreed upon during consultation.

Intellectual Property
You retain ownership of your 3D models. We do not claim any rights to your designs. However, you grant us a limited license to use your files solely for the purpose of fulfilling your order.
Warranty and Quality Guarantee
We warrant that our 3D printing services will be performed with reasonable care and skill using professional grade equipment and materials. We guarantee that:
- Printed items will match the specifications provided in your order
- Materials used will be as specified in your order
- Print quality will meet professional standards
- Items will be free from manufacturing defects
If we fail to meet these standards, we will, at our option, reprint the item at no additional cost or provide a full refund for the defective item.
Warranty Period: 30 days from delivery for manufacturing defects. This warranty does not cover damage caused by misuse, normal wear and tear, or modifications made after delivery.
Limitation of Liability
Our liability is limited to the amount paid for the specific order, except where prohibited by Croatian law. We are not liable for any indirect, incidental, or consequential damages, including but not limited to:
- Loss of profits, business, or revenue
- Loss of data or information
- Loss of goodwill or reputation
- Special, indirect, or consequential loss or damage
- Errors or inaccuracies in information provided by the AI Assistant
Important: Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded by law.
Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, or extreme weather conditions
- War, terrorism, civil unrest, or government actions
- Labor disputes, strikes, or industrial action
- Power outages, internet failures, or technical infrastructure issues
- Shortages of materials or equipment beyond our control
In the event of force majeure, we will notify you as soon as possible and work to minimize the impact on your order. If the delay exceeds 30 days, either party may cancel the contract.
Dispute Resolution
Any disputes arising from these terms or your use of our services will be resolved through the following process:
- Direct Communication: We encourage you to contact us directly at contact@eksaria.com to resolve any issues amicably.
- Mediation: If direct communication fails, we may attempt mediation through a mutually agreed mediator.
- Legal Proceedings: If mediation fails, disputes will be resolved through the Croatian courts.
Consumer Rights: As a consumer, you have the right to use alternative dispute resolution mechanisms, including the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. We will notify you of material changes via email or through our website.
Your continued use of our services after changes are posted constitutes acceptance of the modified terms. If you do not agree to the changes, you must stop using our services and may request a refund for any pending orders.
